1Introductory Provisions

1.1 Driving School Operator

The driving school operator is the company:

Autoškola KSN s.r.o.Company ID (IČO): 24616401Registered office: Líbalova 2348/1, Chodov, 149 00 PragueFile number: C 443689, registered with the Municipal Court in PragueEmail: info@autoskolaksn.cz

1.2 Customer

The Customer is any person who enters into an agreement with the Operator for the provision of services (hereinafter the "Agreement"), the subject of which is tuition and training for the purpose of obtaining a driving licence, or improving the driving skills of a person who already holds the relevant driving licence, to the extent ordered (hereinafter the "Service").

The Operator undertakes to provide the Service in accordance with the Agreement and the applicable legal regulations. The Operator is not responsible for whether the Customer successfully passes the final examination or achieves any other specific result, unless that result depends solely on the proper provision of the Service by the Operator.

A person who, when entering into and performing the Agreement, acts outside the scope of their business activity or the independent exercise of their profession is hereinafter referred to as a "Consumer".

1.3 General Provisions

1.3.1 These terms and conditions (hereinafter the "Terms") govern the mutual rights and obligations of the Operator and the Customer arising in connection with or on the basis of the Agreement.

The Customer is obliged to follow the Operator's instructions, including the rules for booking lessons via the online scheduling system, or in person or by telephone.

The Customer must complete the ordered course no later than one year from the conclusion of the Agreement, unless the Agreement provides otherwise. After this period the Agreement expires, unless legal regulations or the Agreement provide otherwise.

If, for reasons on the Customer's side, the Customer does not book the necessary lessons or does not complete the course within the specified period, the Operator is not liable for the course not being completed, unless this resulted from a breach of the Operator's obligations.

Early termination of the Agreement, including withdrawal from the Agreement, is possible in the cases set out in these Terms or in the applicable legal regulations.

1.3.2 The Terms form an integral part of the Agreement. The Agreement may contain different arrangements, which take precedence over the provisions of the Terms where permitted by law.

1.3.3 The Operator is entitled to amend or supplement the Terms. Changes do not affect contractual relationships established before they take effect, unless the parties agree otherwise or a legal regulation provides otherwise.

1.3.4 Legal relationships between the Operator and the Customer that are not expressly governed by these Terms are governed in particular by Act No. 247/2000 Coll., on Acquiring and Improving Professional Competence to Drive Motor Vehicles, Act No. 89/2012 Coll., the Civil Code, and, in the case of a Consumer, also Act No. 634/1992 Coll., on Consumer Protection, each as amended.

1.3.5 The Operator undertakes to provide the Service in accordance with the requirements laid down by Act No. 247/2000 Coll. and other applicable legal regulations. The Operator undertakes to organise tuition and training in accordance with the Agreement and these Terms.

1.3.6 The Customer is obliged to fulfil the obligations arising from the Agreement, these Terms and the applicable legal regulations.

2Agreement

2.1 Conclusion of the Agreement

2.1.1 The Agreement may be concluded via the order form on the Operator's website autoskolaksn.cz (hereinafter the "Website"). The Agreement is concluded at the moment the order confirmation is delivered to the Customer's email address, unless the confirmation or the chosen method of concluding the Agreement indicates otherwise. The current version of the Terms is attached to the order confirmation.

2.2 Types of Courses Offered

2.2.1 A list of the courses offered by the Operator, including their descriptions, is available on the Website.

2.2.2 The Customer selects a course via the order form on the Website.

2.3 General Conditions for Providing the Service

2.3.1 The Operator undertakes to provide the Service properly, professionally and in accordance with the applicable legal regulations.

2.3.2 The Service is provided on dates according to the Operator's availability, taking into account the Customer's reasonable time preferences.

2.3.3 The Customer is obliged to attend tuition and training on the agreed dates. Breach of this obligation may be considered a serious breach of contractual obligations depending on the circumstances of the case.

2.3.4 The Customer is obliged to follow the instructions of the Operator and of the theory or practical training instructor relating to the safe and proper conduct of tuition and training. Breach of this obligation may, depending on the circumstances, be considered a serious breach of contractual obligations.

2.3.5 The Operator may provide the Service through its employees or other persons authorised to participate in providing the Service in accordance with legal regulations.

2.3.6 The Customer is obliged to provide the Operator with the cooperation necessary for the proper provision of the Service.

2.3.7 One lesson of theory tuition or practical training lasts 45 minutes, unless the applicable legal regulations provide otherwise.

2.3.8 Practical training begins at a pre-agreed place and time. The starting point of the drive is determined by the Operator or the practical training instructor authorised by it. If the Customer is late, the instructor may wait no longer than 15 minutes, after which the drive may be cancelled. Any charging of compensation or a contractual penalty is governed by the relevant provisions of these Terms.

2.3.9 The Customer may cancel a booked practical training drive no later than 24 hours before its agreed start.

2.3.10 For refresher driving or parking courses, the Operator undertakes to enable the Customer to complete the ordered number of practical training lessons.

If the Customer fails to attend an agreed drive and does not properly cancel it in accordance with clause 2.3.9 of these Terms, the drive may be forfeited without entitlement to a replacement drive, provided that the conditions for such a procedure under the Agreement and legal regulations are met.

2.3.11 If, during practical training, the Customer does not demonstrate sufficient knowledge of the road traffic rules under Act No. 361/2000 Coll., the practical training instructor may interrupt the training if this is necessary for safety or for the proper conduct of the training.

The instructor may recommend or require the Customer to repeat the relevant theory tuition to an extent corresponding to the identified shortcomings. Any payment for additional tuition must be communicated to and agreed with the Customer in advance. If no such payment has been agreed and there is no other legal basis for it, it cannot be demanded unilaterally.

2.3.12 The Customer is responsible for the correctness and authenticity of the documents submitted to the Operator. The Customer is obliged to provide true and complete information relevant to the provision of the Service. Knowingly submitting a false or altered document or providing materially false information may be considered a serious breach of contractual obligations.

2.3.13 The Customer must not be under the influence of alcohol or other addictive substances during theory tuition or practical training.

If the instructor has reasonable suspicion that the Customer is under the influence of alcohol or another addictive substance, the instructor is entitled to refuse to start or continue tuition or training and to proceed in accordance with legal regulations and safety requirements.

Refusal of tuition or training due to reasonable suspicion of being under the influence of an addictive substance may, depending on the circumstances, be considered a serious breach of contractual obligations. Any contractual penalties may be claimed only if they have been validly agreed and their application is in accordance with legal regulations.

2.3.14 During practical training, the Customer is obliged to wear suitable footwear that allows safe and sensitive operation of the pedals. Footwear must be sturdy, sit securely on the foot and must not restrict the natural movement of the foot.

If the Customer is wearing unsuitable footwear and this may endanger the safety of the training, the practical training instructor is entitled to refuse to start or continue the drive until suitable footwear is provided. Any financial consequences of the drive's cancellation are governed by the relevant provisions of these Terms and legal regulations.

2.4 Specific Conditions for Training Driving Licence Applicants

2.4.1 Before tuition and training begin, the Customer is obliged to hand over to the Operator a duly completed application for admission to tuition and training and a valid medical fitness assessment, if required by the applicable legal regulations.

The Customer is obliged to notify the Operator without undue delay of any change in health that may affect their medical fitness to drive motor vehicles and to submit the necessary documents, if their submission is required by legal regulations.

Any financial consequences of breaching this obligation may only be claimed to the extent permitted by legal regulations and on the basis of a validly agreed legal ground.

2.4.2 Theory lesson dates are arranged via the Operator's scheduling system, or in person or by telephone.

2.4.3 After completing practical training, the Customer signs the relevant record of completion of tuition and training and agrees with the Operator on the next steps and the date of the final examination. Admission to the final examination is governed by the applicable legal regulations. Before the examination, the Customer is obliged to settle their due obligations to the Operator in accordance with the Agreement.

2.4.4 The Operator undertakes to organise tuition and training so that the Customer can complete the agreed course within the time limit stated for the given course type on the Website, if circumstances and the cooperation of the Customer allow.

If the Customer fails to attend an agreed theory lesson or practical drive without proper cancellation, the course completion period may be reasonably extended. The completion date is calculated from the first practical training drive, if so stated for the relevant course.

2.4.5 The course price does not include fees payable to the competent administrative authority for taking the examination, unless expressly stated otherwise on the Website or in the Agreement.

Any charge for providing the training vehicle or for other services related to the final examination must be transparently communicated to the Customer in advance. Its amount and payment terms are governed by the current price list and the Agreement.

2.4.6 The Customer is obliged to attend the final examination on the agreed date and to bring all documents and aids required for the examination by legal regulations or by the competent administrative authority, in particular valid proof of medical fitness, if required, and corrective glasses where applicable.

If the Customer cannot attend the final examination, they shall notify the Operator without undue delay, if possible no later than 72 hours before the agreed date. Any financial consequences of late notification or non-attendance may only be claimed on the basis of a valid arrangement and in accordance with legal regulations.

2.4.7 The Customer is obliged to pay any fees for a repeated final examination to the competent administrative authority according to its current schedule of fees. The price of the Operator's other services related to a repeated examination must be communicated and agreed in advance.

2.4.8 The Customer may cancel an agreed theory lesson no later than 24 hours before its agreed start. Any financial consequences of late cancellation or non-attendance are governed by the valid arrangement and the applicable legal regulations.

2.4.9 If the Customer fails to attend an agreed drive or theory lesson without proper cancellation in accordance with these Terms, the Operator is entitled to claim only such compensation or contractual penalty as has been validly agreed, is reasonable and whose application is in accordance with legal regulations.

3Payment Terms

3.1 Fee and Method of Payment

3.1.1 The Customer undertakes to pay the Operator for the provision of the Service a fee in the amount stated on the Website for the selected course (hereinafter the "Fee").

The Fee is paid by bank transfer to the Operator's account before the start of the course, unless otherwise stated in the Agreement or on the Website.

Any additional charges that are not part of the Fee must be communicated to the Customer in advance.

4Other Provisions

4.1 Duration and Termination of the Agreement

4.1.1 The Agreement is concluded for a fixed term, usually one year from the moment of its conclusion, unless the Agreement provides otherwise. The Customer is obliged to complete the agreed course within this period, except in cases where legal regulations or circumstances on the part of the Operator require a different procedure.

Termination of the Agreement does not in itself affect the settlement of claims of the parties that have already arisen. Entitlement to the Fee for any part of the Service not provided is assessed according to the Agreement, the actual course of performance and the applicable legal regulations.

4.1.2 If the mutual rights and obligations of the Customer and the Operator are settled before the end of the agreed term, in particular by full provision of the Service and fulfilment of payment obligations, the Agreement may end at that moment.

4.1.3 The Operator may terminate the Agreement in the cases set out by legal regulations or the Agreement, in particular in the event of a serious breach of the Customer's obligations. A health condition of the Customer that prevents the continuation of tuition or training is assessed according to the circumstances of the specific case and the applicable legal regulations.

Termination of the Agreement and any financial settlement must be carried out in accordance with legal regulations. The Operator is not entitled to simply exclude the Customer's right to a refund of part of the Fee if such a right arises from the law or the Agreement.

4.1.4 The Customer is not entitled to assign a claim arising from the Agreement to a third party without the prior written consent of the Operator, unless legal regulations provide otherwise.

4.1.5 Documents relating to the Agreement are delivered to the contact address or email provided by the Customer in the order, unless legal regulations or the nature of the document require a different method of delivery. The Customer is obliged to notify the Operator of any change in contact details without undue delay.

4.1.6 Delivery of documents is governed by the applicable legal regulations. The provisions of these Terms do not change the statutory rules for delivery or proof of delivery.

4.1.7 The Customer agrees to the use of means of distance communication when concluding the Agreement. The Customer bears their own costs of internet connection and telephone calls according to the terms of their service provider. The Operator does not charge any additional costs for the use of means of distance communication beyond the basic rate.

4.1.8 The Customer may request correction of errors in the order by email or by any other contact method stated on the Website. The Operator will make the correction where possible and in accordance with legal regulations.

5Complaints

5.1 Filing and Handling Complaints

5.1.1 The Customer has the right to file a complaint with the Operator regarding a defectively provided Service. It is advisable to file the complaint without undue delay after discovering the defect. The Customer's rights arising from defective performance and the time limits for exercising them are governed by the applicable legal regulations.

5.1.2 If a defect in the Service can be remedied, the Customer may request its removal, substitute performance or a reasonable discount on the Fee, where this corresponds to the nature of the defect and the applicable legal regulations.

5.1.3 If the defect cannot be remedied, or cannot be remedied within a reasonable time, and the defect substantially prevents proper use of the Service, the Customer may request a reasonable discount on the Fee or withdraw from the Agreement, provided the statutory conditions are met.

A Consumer complaint, including the removal of the defect, must be resolved no later than 30 days from the date it was filed, unless the Operator and the Consumer agree on a longer period. If this period expires without result, the Consumer may exercise the rights provided by legal regulations.

5.1.6 After the complaint has been resolved, the Operator will issue the Customer with a confirmation of the date and method of resolution, or a written justification of its rejection.

The withdrawal deadline is met if the Consumer sends the notice before the period expires.
